Definitions

This is the least interesting part of our Privacy Policy, so let's get it out of the way first. "Company", "us", and/or "we", those are all terms for RightTurn, LLC and our affiliates. "Site", that's RightTurn.com and any other website "powered by" our Site (as defined in our Terms of Use) that we maintain. "Privacy Policy" is what you're reading right now. By "Personal Information", we mean any information that uniquely identifies you or can be used to uniquely identify you, contact you, or locate you. "Personal Information" does not include the anonymous information that we collect.

That wasn't too bad, was it? Now, onto the good stuff.

The Right Stance on Privacy

We know that you care about how your Personal Information is collected, used, and shared. That's why we've come up with a Privacy Policy that you'll appreciate. This Privacy Policy describes what type of information is collected when you use the Site, how that information is handled and used, and when that information may be shared with third parties.

Please read this Privacy Policy carefully. Please note that the Privacy Policy applies only to us and those persons or entities maintaining this Site and only to information collected via the Site. It does not apply to websites of other unaffiliated companies-even if we link to those websites. Of course we try to partner, link, and work only with reputable companies, but we do not have access to or control over their sites, the way they do business, or the various features of these third-party sites. If you find yourself on any third-party websites, you should carefully review their privacy policies.

To the extent any portion of this Site is in whole or in part maintained by a third party and not us (i.e. a Dealership, Dealership Group, or an Automobile Manufacturer) they may have their own Privacy Policies which will be separately identified. We encourage you to review these Policies carefully prior to submitting any Personal Information. We are not responsible for the data practices and policies of any third parties.

By visiting this Site you indicate that you have read, agree to, and accept the practices described in this Privacy Policy and consent to the collection and use of the data, including Personal Information as described herein. If you do not agree to these terms, please do not submit any Personal Information through this Site.

 

WHAT INFORMATION WE COLLECT

Non-Personally Identifiable Information

We think this Site is pretty great. (We hope you do too.) But we didn't just guess a whole bunch of times to get to where we are today. A customers' non-personal information is used to personalize and continuously improve the design, content, and overall user experience of the Site. And that's how your non-personal information will be used. It enables us to uniquely tailor your experience with the Site. This non-personal information may also be used to analyze Site usage and for other marketing purposes.

This Site also collects generic non-personal information from visitors to the Site including the number of visitors, the frequency of visits, the pages that are used most frequently, and how often certain functions of the Site are used. These statistics are used, and may be shared with third parties, to continuously improve the Site experience, its offerings, and to make the Site as user-friendly as possible. For instance, with this generic information, we might learn that the "help" feature is clicked more often on a particular page than on other pages. That tells us that we need to improve that particular page.

There are also other ways information is collected about user experiences in order to improve the overall performance of the Site and the experience of our customers. Those may include but are not limited to pop-up surveys, feedback forms, or other methods during Site usage.

Cookies (not the delicious, fresh-out-of-the-oven type)

Through the use of cookies, which are small bits of data cached or stored on your computer during your Internet activity, information is received and stored whenever you interact with us and the Site. These cookies allow the Site to recognize your browsing device. That in turn helps provide you with a better overall experience with the Site. You have the choice to set your browser to accept all cookies, reject all cookies, or notify you when a cookie is set. We of course respect your right to reject all cookies; however, if you do, using the Site may not be as easy, which goes against our goal of getting you the right tires as easily as possible. Rejecting cookies from the Site may also limit the functionality of the Site. For example, you may not be able to proceed to a checkout page or use products or services that require you to log in to the Site.

When you download or use apps created or maintained by us, we may receive information about your location and your mobile device, including your device's unique identifier. Just like with cookies, this is for your benefit. This information can be used to provide you with location-based services and other offerings, such as locating the nearest tire installation specialist. If you don't like the idea of sending us your location information, your mobile device should have an option to turn off location-based services. (See Disabling Location Services, below).

Cookies, clear GIFs, and other similar technology are used to enhance your experience on the Site, monitor individual activity in the aggregate to improve the Site, and provide a better web experience for the viewing public in general. In addition, embedded graphic, text, or script files may be used on the Site so that we and our advertisers, third party service providers, along with the Dealerships, Dealership Groups and OEM's we partner with can track usage of the site for targeted advertising purposes. This tracking technology may be served and monitored from our servers or servers designated by these third parties, and we and/or the third parties may aggregate, publish, distribute, and otherwise use the information regarding usage of the Site. However, this usage information is not tied to Personal Information and the third parties are not permitted to disclose that the information originated from this Site.

We also permit third-party cookies for analytic and ad-serving purposes from Google Analytics and DoubleClick, which are both Google services. See Google's Privacy Policy for full information regarding their privacy practices.

Do Not Track

You also have the choice to enable "do not track" settings on your browser. While we constantly strive to match the rapid pace of technological advancement, at this point, the Site does not take any action based on these browser settings but we reserve the right to do so at a later time in our discretion.

It's a Party, A Third Party

We use third-party analysis services (e.g., Google Analytics) for web log analysis. In using these services, none of your personally identifiable web log information is transferred to these third parties or stored by them on their servers. These services require the use of Javascript code in our web pages in order to transfer the web log information. We then use this information to track how users get to and interact with our website. The Company's analytics vendors may also transfer this information to other third parties where required to do so by law, or where such third parties process the information on behalf of the Company's vendors. By using this Site, you consent to the processing of data by these services in the manner and for the purposes set out above.

The Site uses ClickTale web analytics service. ClickTale may record mouse clicks, mouse movements, scrolling activity as well as text you type in the Site's interactive sections. This site does not use ClickTale to collect any personally identifiable information entered in the Site. ClickTale does not track your browsing habits across websites which do not use ClickTale services (see Clicktale's Privacy Policy). Interest Based Advertising

We may also use cookies, pixels, beacons, or other web tracking technologies to participate in interest-based advertising. We may work with a trusted third party to collect and process this information for us, based on our instructions and in compliance with our Privacy Policy.

This means that you may see advertising on our website tailored to how you browse or shop, or you may see advertising for RightTurn on other websites based on your browsing behavior across websites. Some websites where we may advertise belong to ad networks that use your web browsing history to choose which ads to display on their network websites; these ads include advertising for RightTurn, but no personal information about you is shared with those third party ad networks. Other websites where you see our ads may use interest preferences that you have chosen on those sites, as well as registration and other information about you, to choose which ads to display to you. Some internet browsers, websites, and mobile devices offer opt-outs for interest-based advertising. Please refer to the website that you are visiting, your browser and/or your device settings for additional information.

You can opt-out of receiving interest-based ads from third parties who are members of the Network Advertising Initiative (NAI) or who follow the Digital Advertising Alliance's Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt-out pages on the NAI website and DAA website. RightTurn also follows the regulatory guidelines of the AdChoices online behavioral advertising program. If you receive a behaviorally targeted advertisement, you may click on the displayed icon to receive more information and choose to opt out. Your opt-out choices may be affected by your use of a specific device, your browser settings or your log-on credentials. If you opt out, you may still receive online advertising from RightTurn, which is not based on your preferences or online behavior.

Personally Identifiable Information

Here's some more good news. You can access some areas of the Site without submitting any Personal Information. You can always choose whether to provide us with Personal Information and can also opt-out of any direct marketing or other communications using Personal Information provided to us, by following this Privacy Policy and the Terms of Use for this Site.

If you elect to place an order, make a purchase, establish an account, or sign up for offers or newsletters on or through the Site, we will need to collect some of your Personal Information so that we can complete this process and fulfill your request/order. This information may include but is not limited to your name, physical address, email address, phone number and birthdate, along with information regarding your driving habits, your location and device identifiers (when using mobile devices or our APPS), the make/model/year of your vehicle, and the type and measurements of your vehicle's tires. All of this information is needed to make sure that we correctly and securely process your order, keep you informed, and most of all, get the right tires to your installation specialist.

We know that the web can be a scary place to make purchases. That is why we've taken measures to secure this Site, particularly during the ordering/purchasing stages. As the administrative agent for the Dealership/Dealership Group and/or the OEM when processing your order with a credit card, you will be redirected to a secured website hosted by one of the web's leading providers of payment management services to input your credit card information. The secured website will be maintained in accordance with the Payment Card Industry Data Security Standards, which includes the use of encryption for transmission of order information. Because we use a third-party provider for payment processing, we never store your credit card or other payment information or share it with others. Ever.

Let's face it. There are people out there trying to access your Personal Information. We use reasonable physical, technological, and administrative procedures to protect all Personal Information we collect through the Site. Nevertheless, Internet transmissions are never completely private or secure and, as such, you understand that any messages or information you send to or through this Site may be read or intercepted by others.

How We Use Your Personal Information.

Personal information collected on this Site or any website powered by this Site will be used by us and may be shared with third parties to service, administer and enforce your account along with your order/purchase. These third parties may include your selected installation Dealership where your tires are to be delivered and installed ("Dealership"), its related Dealership Group, if any, in which it is a member, as well as the automobile manufacturer of your car under which tire program a purchase may be made ("OEM"), each of which have the right to request this information through our business relationships. This way, when you show up for your installation and/or service appointment, you will get the quality, personalized service that you expect and deserve.

We, along with the third parties referenced above, may use your Personal Information (i) to communicate with you (including via email and/or text to confirm the details of your purchase) and provide you with the goods and/or services that you requested and/or that the Site provides; (ii) to respond to your feedback, requests, or inquiries (it would be rude not to); (iii) to contact you for general communications, marketing purposes, and promotional materials in connection with the goods and/or services provided by the Site; (iv) for purposes as stated in the "Assignability" section below; (v) to notify you about new goods and/or services which may be available to you; (vi) to fulfill your order; (vii) to contact you to discuss your experience with the Site (thank you in advance); (viii) to enforce the applicable Terms of Use and Terms of Sale; (ix) to provide contact and billing information to trusted partners, such as vendors, providers, or dealers; (x) to contact you with more information regarding the product offering and services we provide; (xi) in connection with the administration and operation of any sweepstakes, contest, or promotion that you choose to enter; or (xii) to communicate with you, trusted vendors, and government agencies,(as necessary), regarding warranties, rebates, recalls, and the DOT tire purchase registration process.

Please keep in mind that we expect authorized third parties with access to your Personal Information to respect your privacy in a manner consistent with our policies and require them to keep your Personal Information secure in accordance with applicable laws, including but not limited to the Gramm Leach Bliley Act, where applicable. However, we cannot guarantee that they will do so.

Mobile Devices - Disabling Location Services.

Most mobile devices provide users with the ability to disable location services. These controls are typically found in the device's "Settings" menu. We recommend you contact your mobile service provider or your device manufacturer if you have any questions in how to disable your device's location services.

The Bottom Line.

Other than sharing Personal Information as described above, or if we are required by law to do so, we do not sell, rent, trade, or otherwise distribute your Personal Information to any third party. That's a relief, isn't it?

About that "required by law" part.

In certain circumstances we may be required by law to disclose Personal Information in response to legal proceedings such as a court order or a subpoena. We may also disclose such Personal Information to law enforcement agencies in response to a law enforcement agency's request involving fraud or other illegal activities. All of this is meant to protect you and your Personal Information.

OTHER PRIVACY MATTERS

Links to Third-Party Websites

As mentioned, the Site may include links to other websites. These third-party websites sometimes use technology to send their website (whose link appears on our Site) directly to your browser. They automatically receive your IP address when this happens. They may also use cookies, clear GIFs, and other similar technologies to measure the effectiveness of the link and/or their respective website. We are not responsible for the policies or practices of these third parties. So while we try to work with only reputable third parties, do not visit these third-party sites unless you are comfortable with their privacy policies.

Children's Privacy

The Site is not directed at children. We do not knowingly collect any Personal Information from children under thirteen (13) years of age unless the collection complies with the Children's Online Privacy Protection Act ("COPPA"). If we discover that a child under the age of thirteen (13) years has provided us with Personal Information, we will delete that child's Personal Information from our system.

Electronic Security

While we work hard to protect the security of your information by using physical, electronic, and managerial procedures as required by law and as we deem reasonable to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online, we cannot guarantee the security of any information that is disclosed by you via the Site. As a result, we make no warranty regarding the security of any information you transmit to us via the Site and you do so at your own risk.

California Transparency in Supply Chains Act

In compliance with the disclosure requirements of the California Transparency in Supply Chains Act of 2010, where applicable, RightTurn, LLC, Dealer Tire, LLC and its affiliated business entities state that we have no policy regarding, and do not monitor human trafficking and slavery in our direct product supply chain. This notification is responsive to Section 1714.43 of the California Civil Code, Section 3, Paragraph D, subparagraph b.

Consent to Transfer

This Site is operated in the United States. If you are located in the European Union, Canada, or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using the Site or providing us with your information, you consent to this transfer. Welcome to the States! Make sure to check out the Rock & Roll Hall of Fame while you're here.

Notice and Revisions to the Privacy Policy

If you choose to visit the Site, your visit and any dispute related to our privacy practices and/or your Personal Information is subject to this Privacy Policy. We may update our Privacy Policy from time to time, but we're not going to pull the ol' switcheroo by collecting your information according to the Privacy Policy, changing the Privacy Policy, then going wild selling your information to anyone who wants it. In other (legal) words, we will not use Personal Information in a manner materially different than as described in the Privacy Policy in effect at the time the information was collected. If we do change the Privacy Policy, the revised Privacy Policy will be effective as of the date it is posted to the Site and as stated in the revised Privacy Policy. You should check our Site frequently to see recent changes. We may also let you know about material changes to our Privacy Policy by posting a notice on the Site.

Assignability & Governing Law

We reserve the right to disclose, share, assign and/or otherwise transfer user information, including without limitation Personal Information, in connection with a merger, acquisition, consolidation, the sale of substantially all of its assets, or any other corporate transfer, exchange, or restructuring, whatever form it may take. You further agree that this Privacy Policy shall be governed by and construed in accordance with the laws of the State of Ohio. Any dispute under or related to this Privacy Policy shall be brought exclusively in the state or federal courts in Cuyahoga County, Ohio.

We just want to reiterate that your Personal Information will not be collected unless you choose to provide it. You may "opt out" of receiving further information about the products and services offered on this Site by notifying us at the address above.
